TechAssist — Safety Disclaimer, Assumption of Risk & Limitation of Liability

IMPORTANT — READ CAREFULLY. This is the most important document governing your use of TechAssist. By creating an account and checking the acceptance box, you agree to everything in this Disclaimer. If you do not agree, do not use the app.
1. TechAssist is an informational tool for qualified professionals only
TechAssist provides AI-generated diagnostic suggestions, testing procedures, parts information, and technical/service documentation ("tech sheets") for household and commercial appliances. All output is informational guidance only. It is intended exclusively for use by trained, qualified appliance-repair professionals who possess the knowledge, licensing (where required), tools, and experience to service appliances safely.
TechAssist is not intended for consumers, hobbyists, or untrained individuals, and is not a substitute for:
- your own professional training, judgment, and experience;
- the appliance manufacturer's official service documentation and safety instructions;
- applicable electrical, gas, plumbing, building, and safety codes;
- OSHA and other workplace-safety requirements; or
- any license or certification required in your jurisdiction.
2. The information may be incomplete, outdated, or wrong
TechAssist's diagnostics are produced in part by artificial intelligence, which can and does make mistakes, including generating information that is inaccurate, incomplete, outdated, or entirely incorrect ("hallucinations"). Tech sheets and parts data are aggregated from third-party sources that we do not control and cannot guarantee.
You must independently verify all information — including model numbers, part numbers, wiring, measurements, procedures, and safety warnings — against the manufacturer's official documentation and your own professional judgment before acting on it. Never rely on TechAssist as your sole source of information for any repair.
3. Safety is your responsibility — assumption of risk
Appliance repair involves serious hazards, including but not limited to electric shock, electrocution, fire, explosion, gas leaks, burns, sharp edges, moving parts, refrigerants, water damage, and property damage.
By using TechAssist, you acknowledge and agree that:
- You are a qualified professional and will follow all applicable safety procedures, including lockout/tagout, de-energizing equipment, verifying absence of voltage, and following manufacturer and code-required safety steps, regardless of what TechAssist does or does not say;
- Any safety warnings shown in the app are general reminders, not a complete safety plan, and their absence does not mean a step is safe;
- You knowingly and voluntarily assume all risks of personal injury, death, and property damage arising from appliance-repair work, including any work informed by TechAssist; and
- You are solely responsible for the safety of yourself, your coworkers, your customers, and their property.
4. No warranties — provided "AS IS"
TECHASSIST IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the service will be uninterrupted, error-free, secure, or that any information will be accurate or reliable.
5. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- We are not liable for any injury, death, property damage, business loss, or other harm resulting from or related to your use of TechAssist or your reliance on any information it provides;
- We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, even if advised of the possibility; and
- Our total aggregate liability for any and all claims relating to TechAssist will not exceed the greater of (a) the total fees you paid us in the twelve (12) months before the event giving rise to the claim, or (b) US $100.
You agree these limitations are a fundamental basis of the bargain and apply even if a limited remedy fails of its essential purpose.
Note: Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. Nothing in this Disclaimer limits liability that cannot be limited under applicable law (such as liability for gross negligence, recklessness, or intentional misconduct, where the law so provides).
6. Indemnification
You agree to defend, indemnify, and hold harmless NIXAR HOLDINGS LLC and its owners, members, and affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of TechAssist, your repair work, or your violation of this Disclaimer or the Terms of Service.
7. Professional acknowledgment
By accepting, you represent that you are at least 18 years old and a qualified appliance-repair professional, and that you understand and accept the risks described above.
This Disclaimer is incorporated into and part of the TechAssist Terms of Service.
