TechAssist — Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and NIXAR HOLDINGS LLC governing your use of the TechAssist mobile application and related services (the "Service"). By creating an account, checking the acceptance box, or using the Service, you agree to these Terms, the Privacy Policy, and the Safety Disclaimer. If you do not agree, do not use the Service.
TechAssist is an independent product and is not affiliated with any appliance manufacturer or any other business.
1. Eligibility & professional use
You must be at least 18 years old and a qualified appliance-repair professional to use the Service. The Service is intended for the United States only. You are responsible for all activity under your account and for keeping your login credentials secure. One account is for one user; do not share credentials (see your plan's seat terms).
2. The Service
TechAssist provides AI-generated appliance diagnostics, testing guidance, parts information, and technical/service documentation. All output is informational only and may be inaccurate or incomplete. Your use of any output is governed by the Safety Disclaimer, which is incorporated into these Terms and which you must read.
3. Subscriptions, billing & refunds
- Some features require a paid subscription. Plan features, prices, and limits are shown in the app and may change with notice.
- Paid plans renew automatically each billing period until canceled. You may cancel anytime; cancellation stops future renewals and takes effect at the end of the current period.
- Refunds: If you purchase through the Apple App Store or Google Play, refunds are handled by those stores under their policies. If you purchase directly through our web checkout, fees are non-refundable except where required by law, though we may grant refunds at our discretion.
- Promotional codes and free-access coupons are offered at our discretion, are non-transferable, have no cash value, and may be revoked or expire.
4. Acceptable use
You agree not to:
- use the Service for anything other than your own legitimate appliance-repair work;
- copy, scrape, harvest, resell, redistribute, or sublicense the tech-sheet library, diagnostics, or any content;
- share, resell, or provide access to your account beyond your plan's seats;
- use bots, scrapers, or automated means to access the Service, or exceed rate limits;
- reverse-engineer, decompile, or attempt to extract source code or models;
- upload unlawful, infringing, or harmful content; or
- interfere with, overload, or attempt to gain unauthorized access to the Service or its data.
We may suspend or terminate accounts that violate these Terms, with or without notice.
5. Intellectual property
The Service, including its software, design, and compiled content, is owned by NIXAR HOLDINGS LLC and protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your own professional repair work, subject to these Terms. Tech sheets and other documentation are provided for your reference in performing repairs and remain the property of their respective owners; you receive no ownership rights in them.
6. Third-party services & content
The Service relies on third-party sources and services (including parts data and service documentation) that we do not control. We are not responsible for their accuracy, availability, or terms. Your use of third-party content must comply with any applicable third-party restrictions.
7. Disclaimers & limitation of liability
The Safety Disclaimer governs all warranties, assumption of risk, and limitation of liability and is incorporated here by reference. Without limiting it: the Service is provided "AS IS"; we disclaim all warranties; and our total liability is limited as set out in the Safety Disclaimer.
8. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access for violation of these Terms, for legal reasons, or if we discontinue the Service. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, indemnification, and dispute terms) will survive.
9. Dispute resolution — arbitration & class-action waiver
Please read this carefully; it affects your legal rights.
- These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules.
- Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration rather than in court, except that either party may bring an individual claim in small-claims court.
- You and we waive any right to a jury trial and to participate in a class action or class-wide arbitration. Disputes must be brought in your individual capacity only.
- (If arbitration is unenforceable in your jurisdiction, disputes will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.)
10. Changes to these Terms
We may update these Terms. For material changes, we will notify you (in-app and/or by email) and require renewed acceptance before continued use. The "Last updated" date reflects the current version. Continued use after non-material changes constitutes acceptance.
